Amends Division 105 (Communicable Disease Prevention & Control), Part 6 (Veterinary Public Health & Safety), Chapter 9 (Pet Store Animal Care) of CA Health & Safety Code to exclude a society for the prevention of cruelty to animals shelter, humane society shelter, or rescue group from the list of organizations from which a pet store operator may obtain a live dog, cat, or rabbit for purposes of selling that animal.

Amends Division 105 (Communicable Disease Prevention & Control), Part 6 (Veterinary Public Health & Safety), Chapter 9 (Pet Store Animal Care) of CA Health & Safety Code by repealing and replacing Section 122354.5 to further restrict the sale of dogs, cats, and rabbits in pet stores.

Amends Article 9.5 (Disaster Preparedness) of the CA Government Code by adding a new Section 8608.1 to require kennel owners to create and submit to the city or county an animal natural disaster evacuation plan for any kennel covered by the license or permit.

Amends Division 105 (Communicable Disease Prevention & Control), Part 6 (Veterinary Public Health & Safety) of the CA Health & Safety Code by adding a Chapter 12 (Dog Trainer Sufficiency Act) to regulate dog trainers, dog training facilities, and dog training facility operators.

Amends: 1) Division 105 (Communicable Disease Prevention & Control), Part 6 (Veterinary Public Health & Safety), Chapter 5 (Sale of Dogs and Cats) of CA Health & Safety Code by adding a new Article 4 to provide for the sale of emotional support dogs; and Part 1 (Crimes & Punishments), Title 9 (Crimes Against the Person Involving Sexual Assault and Crimes Against Public Decency) of CA Penal Code to provide for crime of misrepresentation of service dogs.

Amends Chapter 11 (Veterinary Medicine), Article 3 (Issuance of Licenses) of the CA Business & Professions Code by adding a new Section 4853.8 to require all premises where veterinary medicine, veterinary dentistry, veterinary surgery, and the various branches thereof are being practiced to be registered with the Veterinary Medical Board.

Amends California Food & Agricultural Code by adding Sections 31108.3 and 31752.1 to require that dogs and cats be microchipped prior to release from public animal control agencies and shelter or rescue groups.

Amends Division 3 (Fish and Game Generally), Chapter 2 (Importation, Transportation and Sheltering of Restricted Live Wild Animals), Section 2120 of CA Fish & Game Code and Part 1 (Crimes and Punishments), Title 14 (Malicious Mischief), Section 597.3 of CA Penal Code to restrict live animal markets and to add certain prohibitions on the importation and possession of wild animals.

ORD 2019001

Amends Title 8 (Animals) of National City, CA Municipal Code by adding a new Chapter 8.38 which would further restrict the retail sale of dogs, cats and rabbits by closing a loophole in CA AB 485 which allows pet stores to have monetary or ownership interest in the animals and to retain adoption fees.
